Russia begins first trial of Russian military personnel for voluntary surrender

The Moscow Garrison Military Court is beginning to consider the high-profile case of Junior Sergeant Roman Ivanishin, who was accused of voluntarily surrendering to the enemy during a special military operation. Ivanishin became the first serviceman to be tried under the article for surrendering without signs of treason, as well as for desertion. According to the investigation, Ivanishin, a former miner, tried to surrender to Ukrainian troops twice, and once succeeded. He himself is originally from the city of Shakhtyorsk on Sakhalin, where he was detained shortly after returning to his homeland. He is currently in custody awaiting a court decision. Investigative bodies accuse him under several articles of the Criminal Code of the Russian Federation, and if found guilty, he faces up to 10 years for voluntary surrender and up to 15 years for desertion.

According to the case materials, the incident occurred on June 10, 2023, near the village of Stepnoye, Volnovakha district, Donetsk People's Republic, where Ivanishin was a mobilized serviceman. After being captured, he recorded a video statement in which he expressed a negative attitude towards the special operation, stating that he and his fellow soldiers did not want to participate in hostilities. Ivanishin spent six months in captivity, and then, in January 2024, he returned to Russia with a group of 248 servicemen on a plane that arrived at the Chkalovsky airfield near Moscow.
