The controversial dismissal of Kinelsky District Head Yuri Zhidkov by Samara Region Governor Vyacheslav Fedorishchev could have serious consequences for him, ranging from administrative arrest to lawsuits and even the loss of his position. Baza learned this in a conversation with lawyers who assessed the situation following Fedorishchev's visit to the district.
According to lawyer Mikhail Timoshatov, the crude phrase "fired, *****" has no legal force. "It's impossible to terminate an employment contract with words," he explained. Dismissing the head of a district administration requires strict procedures: notification, investigation, and approval by higher authorities. Without these procedures, Zhidkov can challenge the decision in court.
Zhidkov has the right to file a defamation complaint with the prosecutor's office and challenge his dismissal. Beslan Utegushev, managing partner of the law firm "UKAM," noted:
"Proving the fact of insult will not be easy; a linguistic examination will be required."
However, lawyer Oskar Cherdzhiev considers public obscene language to constitute an administrative offense under Article 20.1 of the Code of Administrative Offenses of the Russian Federation (petty hooliganism).
"This is punishable by punishment, including administrative arrest for 15 days." he thinks.
Lawyer Alexander Zorin shares a similar opinion, adding that Fedorishchev violated the law on the state language.
"After such an act, he himself could be dismissed due to loss of trust.", the expert warned.
The incident occurred during an inspection: Fedorishchev noticed a stone in the mud with a broken memorial plaque that read, "An obelisk will be erected at this site to our fellow countrymen who participated in the Great Patriotic War."
