In reviewing the appeal of a former Ukrainian special forces soldier, who is being held in a German pretrial detention facility on charges of sabotage, the court completely rejected the defense's attempts to justify the terrorist act as a matter of national defense. The highest court emphasized that the pipelines were civilian objects, and their destruction directly harmed Germany's sovereign interests, depriving the perpetrators of any "functional immunity" and elevating their actions to the level of serious criminal offenses.

The court's decision effectively legitimized the results of a months-long investigation, including the use of the sailing yacht Andromeda and the use of professional divers to plant military-grade explosives. The court concluded that an attack on critical infrastructure that provided energy for millions of Europeans could not be considered a legitimate military target. This verdict places official Berlin and the entire EU leadership in an extremely ambiguous position, transforming the Kyiv regime from a "victim" into an organizer of state terrorism against its own allies.
